Terms of Service

By accessing or using the Propspedia platform ("Platform") — including the website at propspedia.com and any associated mobile applications — you agree to be bound by these Terms of Service ("Terms"). These Terms form a legally binding agreement between you and Propspedia Pvt. Ltd., a company incorporated in India.

If you do not agree to these Terms, you must immediately stop using the Platform. Your continued use following any update to these Terms constitutes acceptance of the revised Terms.

To use the Platform, you must:

• Be at least 18 years of age.
• Have the legal capacity to enter into a binding contract under Indian law.
• Not be prohibited from receiving our services under applicable law.
• Provide accurate, complete, and current information during registration and use.

By using the Platform, you represent and warrant that you meet these requirements. If you are using the Platform on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

Propspedia provides an online real estate discovery and listing platform connecting buyers, tenants, builders, and agents. The Platform is intended for informational purposes and to facilitate introductions between parties. We are not a real estate broker, agent, or transaction intermediary.

You may use the Platform to:

• Search, browse, and save property listings and project information.
• Submit enquiries to builders, developers, or their representatives.
• Create an account and manage your property preferences.
• Post reviews and ratings about properties and builders.
• Access real estate tools such as EMI calculators and area guides.

When you create an account on the Platform, you are responsible for:

• Maintaining the confidentiality of your password and account credentials.
• All activity that occurs under your account, whether or not authorised by you.
• Immediately notifying us of any unauthorised access to your account at [email protected].
• Keeping your account information accurate and up to date.

We reserve the right to suspend or terminate accounts that we suspect are being used fraudulently, in violation of these Terms, or in a manner harmful to other users or third parties.

All property listings, project details, prices, and availability information on the Platform are provided by builders, agents, and other third-party data sources. Propspedia does not independently verify all listing details and makes no representation as to their accuracy or completeness.

Users who post content on the Platform (reviews, comments, photos) grant Propspedia a worldwide, royalty-free, non-exclusive licence to use, reproduce, modify, and display such content in connection with operating and promoting the Platform.

You represent that any content you submit:

• Is accurate and not misleading.
• Does not infringe the intellectual property, privacy, or other rights of any third party.
• Does not contain defamatory, offensive, or illegal material.
• Does not include spam, promotional content not authorised by Propspedia, or malware.

Builders and agents who list projects or properties on Propspedia ("Listers") agree to the following additional obligations:

Certain features of the Platform — including featured listings, premium builder profiles, and lead generation packages — may require payment. By subscribing to a paid plan:

• You agree to pay the applicable fees as displayed at the time of purchase.
• All payments are processed through secure, PCI-DSS compliant third-party gateways.
• Fees are non-refundable unless otherwise stated in a specific offer or required by applicable law.
• Recurring subscriptions auto-renew unless cancelled at least 5 days before the renewal date.
• We reserve the right to change pricing with 30 days advance notice to subscribers.

All prices are in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise.

All content on the Platform — including the Propspedia name and logo, website design, software, text, graphics, data compilations, and proprietary tools — is owned by or licensed to Propspedia Pvt. Ltd. and is protected by Indian and international intellectual property laws.

You may not:

• Reproduce, redistribute, or republish any Platform content without prior written consent.
• Scrape, crawl, or extract data from the Platform using automated means without authorisation.
• Use our branding or trademarks in any manner that suggests endorsement or affiliation.
• Reverse-engineer or decompile any software or technology underlying the Platform.

You agree not to:

• Post false, misleading, or fraudulent listings, reviews, or information.
• Impersonate any person, builder, or entity, or misrepresent your affiliation.
• Use the Platform to harass, threaten, or harm other users.
• Circumvent security measures, access systems without authorisation, or introduce malicious code.
• Use the Platform for any unlawful purpose, including money laundering or fraud.
• Collect or harvest personal data of other users without consent.
• Send unsolicited communications (spam) to other users.

Violation of these prohibitions may result in immediate account suspension, permanent ban, and referral to appropriate law enforcement authorities.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Propspedia does not warrant that: (a) the Platform will be uninterrupted or error-free; (b) any listing information is accurate, complete, or current; (c) the Platform is free of viruses or other harmful components.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW, PROPSPEDIA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR ANY TRANSACTION ENTERED INTO BASED ON INFORMATION FOUND ON THE PLATFORM.

Our aggregate liability for any claim arising out of or relating to these Terms or the Platform shall not exceed the amount you paid to Propspedia in the 12 months preceding the claim, or ₹10,000 (ten thousand rupees), whichever is greater.

You agree to indemnify, defend, and hold harmless Propspedia Pvt. Ltd. and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use of the Platform in violation of these Terms.
• Content you submit, post, or transmit through the Platform.
• Your violation of any third-party rights, including intellectual property or privacy rights.
• Any transaction or dispute between you and a builder, agent, or other user.

You may terminate your account at any time by emailing [email protected] or using the account deletion option in your settings.

We may suspend or terminate your access to the Platform at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable in our reasonable discretion. Upon termination, all licences granted to you under these Terms immediately cease.

These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes arising from these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts of Chennai, Tamil Nadu.

Before initiating legal proceedings, we encourage you to contact us at[email protected] so we can attempt to resolve the matter informally within 30 days.

We may modify these Terms from time to time. We will provide at least 14 days' notice of material changes via email or a prominent notice on the Platform. Your continued use of the Platform after the effective date constitutes your acceptance of the updated Terms.
